Notes:
evergreen, 3′-4′ tall have not seen fruit or flowers no real color change as seasons change

The leaves & stems are not close enough to tell more. Also without its flowers to help narrow down, I’m guessing this might be a type of gardenia (?). If this is a gardenia, to my eyes its leaves appear to have some problems. Check out one of the cultivar of gardenia, the Gardenia radicans. Again, I’m speculating.
